Terms and Conditions

Introduction

These Terms and Conditions govern your use of the website viziflow.com and the services provided through it. By accessing or using our website, you agree to comply with and be bound by these Terms. If you do not agree with any part of these terms, please do not use our website. 1. Use of the Site

By using our Site, you agree to use it in a lawful manner and not engage in any behavior that could harm the Site or other users.

2. Information and Products

We strive to provide accurate descriptions of our products. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free. Product warranties vary between 12 and 24 months, depending on the specific equipment model you choose, as detailed in the warranty provided with the order.

3. Payment Methods

We accept payments through credit or debit cards, other methods accepteble via PayPal, Stripe, and direct bank transfers. For other payment methods, please contact us. By placing an order, you agree to provide valid payment information and authorize us to charge the specified amount.

4. Ordering Process

To place an order:

  1. Browse our product catalog, select the desired items and configuration options.
  2. Add items to your cart or click button “Order Now”.
  3. Proceed to checkout and provide the necessary billing and shipping information.
  4. Choose your preferred payment method and complete the payment.
  5. You will receive an order confirmation via email.

Your order is confirmed upon successful payment.

If we are unable to supply you with the Products for any reason, we will inform you of this by email and we will not process your order. If you have already paid for the Products, we will refund you the full amount including any delivery costs charged as soon as possible.

5. Order Cancellation

You may cancel your order within 2 hours of placing it. Please note that we do not refund the fees charged by payment processors. To cancel an order, contact us immediately.

6. Returns and Refunds

We offer refunds in specific circumstances covered in our Terms and Conditions:

a. If we cannot accept your order:
– If we are unable to supply you with the Products for any reason, we will inform you of this by email and we will not process your order. If you have already paid for the Products, we will refund you the full amount, including any delivery costs charged, as soon as possible.

b. Incorrect prices:
– Despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered, we will contact you to inform you of this error and give you the option of continuing to purchase the Products at the correct price or canceling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as canceled and notify you in writing. If we mistakenly accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may cancel the supply of the Products and refund you any amounts you have paid.

c. No delivery of Goods:
– If we fail to deliver the Goods, our liability is limited to the refund of the amount received from you as payment for the Goods. However, we will not be liable to the extent that any failure to deliver was caused by a Force Majeure Event or because you failed to provide adequate delivery instructions or any other instructions that are relevant to the supply of goods.

d. Nonconforming Goods:
– Please refer to Section 8 of our Terms and Conditions for full details regarding the refund option under the warranty terms. Customized or individually configured products are generally non-refundable unless they are covered under warranty. Exceptions may be made in cases of significant issues or errors; please contact us with a detailed explanation of your situation.

e. Cancellation due to a Force Majeure Event:
– You may cancel the contract affected by a Force Majeure Event which has continued for more than 30 days. To cancel, please contact us.

7. Shipping Policy

We aim to ship products promptly after the order is confirmed. Delivery times may vary based on location and other factors. We are not responsible for delays caused by external factors. In case of damage during shipping, please document the damage with photos or videos and contact the delivery service immediately for compensation. Also, notify us to assist with the process.

8. Warranties and Liability

8.1 VIZIFLOW Limited Warranty Terms are incorporated by reference into the Contract and/or attached to the order/product and take precedence over these Terms and Conditions with respect to the scope of the warranty. We provide a warranty for the period specified in the VIZIFLOW warranty if the products are:

a. correspond in all material respects to its description and configuration;
b. be free from significant defects in design, materials and workmanship; and
c. be of satisfactory quality (within the meaning of the Sale of Goods Act 1979). 



8.2 Subject to clause 8.3, if:

a. you notify us in writing within a reasonable period of time after discovering that some or all of the Products are covered by warranty and meet the requirements set out in clause 8.1; and
b. we are provided with detailed information about the defects and/or other details of the warranty claim and a reasonable opportunity to become familiar with the Products; and
c. If we ask you to do so, you will return the Products to us at your expense, then we will, at our option, repair or replace the defective Products or refund the price of the defective Products in full. 



8.3 We will not be liable for any breach of the warranty set out in clause 8.1 if:

a. you continue to use the Products after notice to us in accordance with clause 8.2;
b. you modify or repair the Products without our written consent, except for replacing components (rotor, stator, arms) in accordance with the instructions received from us;
c. the defect arises as a result of normal wear and tear, intentional damage, negligence or improper storage or operating conditions; or
d. Products differ from their description or specification as a result of changes made to comply with applicable legal or regulatory requirements; or
e. The defect arises because you failed to follow our instructions for storing, commissioning, transporting, installing, using and maintaining the Products or (if there are none) good trade practice in relation to them.



8.4 We will be liable to you for any failure of the Products to conform to the warranty set out in clause 8.1 only to the extent set out in this clause 8.

8.5 The conditions imposed by sections 13 to 15 of the Sale of Goods Act 1979 are to the maximum extent permitted by law are excluded from the Contract.

8.6 These Terms also apply to any repaired or replacement Products supplied by us to you.

10. Governing Law

These Terms are governed by the laws of the United States, specifically the state of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the appropriate courts located in Florida. Our services are available worldwide, and users agree to comply with local laws as applicable.

11. Changes to the Terms

We reserve the right to modify these Terms at any time. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. We will notify you of any changes by updating the date at the top of these Terms.
